To the extent of any inconsistencies or conflicts between these English Terms of Service and Tellement Facile Sàrl's Terms of Service available in another language, the French version of the Terms of Services will prevail.
General Terms and Conditions of Sale (GTCS)
Authorized Clients:
You must be 18 years or older, sane of mind and have the exercise of your civil rights to order through the Website.
Scope of application and modification of the GTCS:
The GTCS govern the contractual relationship - and are part of the contract - between Tellement Facile Sàrl and the Client.
By ordering on the Website the client recognize having read, understood and accepted, without any reserve, the GTCS. If it is not the case, the Client do not order through the Website.
Tellement Facile Sàrl reserves the right to modify the GTCS without notice at any time by publishing a new version of the GTCS on the Website (which nullifies and replace the old version). Any order made after the publication by Tellement Facile Sàrl of a new version of the GTCS means acceptation of the new version.
Order process:
By ordering a product on the Website the Client make a firm and definitive offer to buy the selected product, this à the conditions indicated on the Website. The validity of the offer might be subject to a maximum or minimum quantity. From a legal point of view, the Client makes his offer when his payment is approved. The sale is accepted when Tellement Facile Sàrl sends the Confirmation of Order to the Client. Tellement Facile Sàrl reserves the right to refuse an offer without liability and without having to give his motives.
Price:
Tellement Facile Sàrl reserves the right to modify his prices at anytime. The sole reliable price is the one on the Confirmation of Order.
Prices on the Website are in Swiss Francs (CHF), the VTA is included.
Cost of packing and delivery are charged in accordance with the indications written in the Confirmation of Order.
Payment:
Methods of payment accepted by Tellement Facile Sàrl are solely the ones indicated on the Website.
Any offer of order is subject to the condition of the payment of the entirety of the price of the order and the costs of delivery. If Tellement Facile Sàrl refuses the offer, the amount already paid by the Client is reimbursed (interest-free).
The risk of a malfunction of the payment system is supported by the Customer. Tellement Facile Sàrl will not be liable in the event of any problem arising regarding the payment.
Delivery:
Cost of packing and delivery are those written in the Confirmation of Order.
Products are sent to the address of delivery indicated by the Client during the order. It is the Client responsibility to give the right address to Tellement Facile Sàrl. Tellement Facile Sàrl will not be liable for an absence of delivery in the eventuality of an incorrect/outdated address
Tellement Facile Sàrl has fulfilled his obligation to deliver when he has delivered the goods to the carrier. Costs and risks are transferred at the moment the carrier takes charge of the goods.
If a package is sent back to us by the carrier who did not manage to deliver it to the Client (incorrect address, etc.) an e-mail is sent to the client to the electronic address of his account on the Website or the electronic address he provided to Tellement Facile Sàrl during the order. The client has a period of three months to answer the message and give a correct address. Without any notice from the Client in the period of 3 months, the order is cancelled. Tellement Facile Sàrl is then freed from his obligation to deliver and the amount paid by the Client is kept by Tellement Facile Sàrl as a contractual penalty. Tellement Facile Sàrl has no further claim against the Client regarding the delivery.
The costs of delivery and inherent risks of a returned package (including the eventuality where the carrier would not give a delivery notification to the Client) and/or and the eventuality of having the redeliver have to be paid solely by the Client. He is also responsible for the inherent risks of the storage of the returned goods. Before to redeliver, Tellement Facile Sàrl can request from the Client to pay all those charges.
Warranty for the defects:
UPON RECEPTION OF HIS ORDER, THE CLIENT MUST IMMEDIATELY INSPECT THE DELIVERED GOOD
BEFORE SIGNING THE DELIVERY ORDER GIVEN BY THE CARRIER, THE CLIENT MUST CHECK THAT THERE ARE NOT OBVIOUS DEFECTS AT THE MOMENT OF THE DELIVERY (NOT THE RIGHT PRODUCT ETC.). IN CASE OF OBVIOUS DEFECTS, THE CLIENT (OR ANYONE ACCEPTING THE DELIVERY IN HIS NAME) MUST INDICATE IT THROUGH THE WRITING OF A SIGNED RESERVE ON THE DELIVERY ORDER. WITHOUT SUCH RESERVE, THE DEFECTS ARE CONSIDERED ACCEPTED BY THE CLIENT.
REGARDING THE DEFECTS WHO ARE NOT VISIBLE AT THE TIME OF THE DELIVERY, THE CLIENT MUST CONTACT TELLEMENT FACILE SÁRL IN A PERIOD OF 3 BUSINESS DAYS AS SOON AS HE HAS SEEN THE DEFECT. IF THE CLIENT DOES NOT CONTACT TELLEMENT FACILE SÁRL BEFORE THE END OF THE AFOREMENTIONNED PERIOD, THE DEFECT WILL BE CONSIDERED ACCEPTED BY THE CLIENT.
Revocation:
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Our policy lasts 15 days (since the delivery). If 15 days have gone by since the delivery, unfortunately we can't offer you a refund or exchange.
The customer alone bears the risks associated with returning the goods. Except in the case of a return justified by the defects of the goods, the costs of the return have to be paid by the Client.
To return a product, you must send us the invoice of your order or other proof of purchase.
Refund:
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
The refund accounts for balance of all accounts and claims. Customer may thus in no case claim to Tellement Facile Sàrl for additional damages.
